1 Dress Code Policy

1.1 Although The Sussex Exchange Cinema operates a more relaxed Dress Code Policy. Should a customer choose to make use of the Restaurant, Mia Lounge or any other facilities at The Sussex Exchange before or after any performance, please note that the Dress Code will still be applicable at all times. The Sussex Exchange would appreciate the customers full cooperation to avoid disappointment.


2 Overview

2.1 The following terms ("Terms") apply to any use by the customer ("Customer") of the Sussex Exchange Cinema ("Cinema"), and should be read carefully before being accepted by the Customer when purchasing a Cinema ticket either online via our website cinema.thesussexexchange.co.uk ("Website”).

2.2 By using this service the Customer accepts and agrees to be legally bound by these Terms and acknowledges that Sussex Refreshments Ltd T/A The Sussex Exchange ("TSSL”), as the owner and operator of the Sussex Exchange Cinema. As the owner and operator of the Cinema, TSSL has the right to amend or change these Terms at any time; at its sole discretion. Any changes made will take effect immediately; the date of said changes will be clearly marked within these Terms.

2.3 In certain circumstances TSSL may offer additional promotions and/or services that coincide with the Cinema, for example seasonal events, and promotions. If so, you will be prompted to view such additional terms and conditions on our Website at the time of such purchase(s) and those terms and conditions will apply in addition to these Terms.

2.4 All materials on the Website and all intellectual property rights are owned and/or controlled by TSSL and its licensors. All material on the Website is protected by copyright. Permission is granted only to electronically copy and/or print in hard copy portions of the Website for personal non-commercial purposes. Any other use of the materials on the Website (including but not limited to making such material available on any other website, online service, bulletin board or networked computer environment) is strictly prohibited without permission from TSSL and its licensors.


3 Purchasing of Tickets

3.1 You can purchase tickets for films currently showing and pre-book film tickets in advance via our Website only.

3.2 By ordering tickets via the website, you will only be able to book seats that coincide with the availability of the particular film and screening time you have chosen. This availability will be clearly given via on-screen information.

3.3 All Cinema bookings must be paid for in advance; bookings will only be confirmed once payment has been made on-line. All seats are sold on a first come, first serve basis and are non refundable or transferable.

3.4 When selecting seats for a particular performance they will only be reserved for a maximum of 15 minutes from the time the chosen seats are selected. After this time if payment has not been made these seats will be available to other Customers, and you may be asked to select alternative seats.

3.5 We operate a dynamic pricing system therefore ticket prices will relate to the performance you have selected, the price quoted may also change depending on the date, time and seating options chosen. Please also note that ticket prices vary and will be higher for peak times and VIP seating, however the total price will be clearly shown on our Website. All prices and fees include value added tax ("VAT”).

3.6 We offer a strict no refunds policy so we are unable to refund you or exchange ticket(s) in the event that you make any error when purchasing your tickets on-line (including but not limited to selecting the wrong film or the wrong number of tickets, dates or times, personal sickness or any other circumstances).

3.7 TSSL reserves the right to reject a Cinema booking for any reason at any time, in this event TSSL’s liability will be limited to a full refund of the fees paid to the Customer.

3.8 Additional VIP seating can be chosen by Customers when placing a booking, please note however that these seating options are on a first come first serve basis. The VIP seating is only purchasable as a couple and not as a single. The additional price of these seating options will be clearly stated on our Website.

3.9 When purchasing tickets for 3D films, you will be required to purchase 3D glasses, this additional cost will be clearly stated either on our Website. These glasses will then be given to Customers when attending the chosen performance. Please note, to maintain the quality and standard third-party 3D glasses will not be permitted.

3.10 When placing a booking for the Cinema you will not be given physical/printed tickets. You will be given a booking reference number, you will also receive an e-ticket via email and your booking reference number will also be confirmed via text message ("SMS”), if you have provided a valid mobile phone number at the time of booking. When attending your performance you will be required to either quote your booking reference, name or show your e-ticket to a member of staff.

3.11 Each cinema ticket booking made online is subject to a £1.00 per person booking fee, please note that this is a non-refundable fee.


4 Performance Times

4.1 Tickets are subject to availability, the dates, times and seats available for a particular performance will be clearly stated on our Website. TSSL will endeavour to ensure that advertised film schedules are met.

4.2 All performance dates and times are confirmed in advance between TSSL and each of the film studios. These dates and times cannot be altered at short notice without permission from said studios. TSSL cannot take responsibility for issues with any particular performance due to requests or withdrawals by the film studios.

Please note however that TSSL will endeavour to provide alternative viewing times and/or refunds in the event of the above stated reasons that affect any performance(s), however this is at the discretion of TSSL.

4.3 All films will aim to be started at the exact time advertised, unfortunately we are unable to hold a performance should the customer be late. The customer is fully responsible to make provisions and attend on time.


5 Film Classifications & Children

5.1 Due to licensing restrictions this is an adult only cinema for customers aged 16 years and over, no customers under the age of 16 years will be permitted into the cinema (this is regardless of the film rating advertised).

5.2 Entry to performances is restricted by the classification given by the British Board of Film Classification (“BBFC”). Each rating will be clearly shown on our Website at the time of booking. We are required to refuse admission to anyone who is below the minimum age required by law.

5.3 We reserve the right to ask for proof of age with appropriate photographic ID if you are watching any performances with a rating of 12A, 15 or 18 or when purchasing alcoholic beverages. If you are unable to provide this upon request you will not be able to watch the performance or buy an alcoholic drink. We reserve the right to ask for such proof at any time you are on our premises.

5.4 In some circumstances performances will be advertised prior to receiving a rating, in this event if you purchase a ticket before a performance has been classified by the BBFC and you are not old enough to be admitted, our liability will be limited to a full refund of the attendees seat price.

5.5 Children under the age of 18 cannot be admitted to films classified as 18.

5.6 Parents and guardians shall at all times remain responsible for their child(ren).

5.7 For the purpose of the rules set out in section [4], an Adult is a person aged 18 years or over.

6 Admissions Policy

6.1 Customers must not engage in any act or speak to, any staff, or other Customers in a manner which may offend, insult, intimidate or threaten any person on any basis whatsoever including but not limited to race, religion, colour, ethnic origin, gender or that person’s physical attributes. Any of the above may result is expulsion from the premises without refund and a permanent ban in line with our zero tolerance policy.

6.2 Sound and video recording equipment (including but not limited to cameras and mobile devices with recording features) is not permitted while a performance is in progress. It is a serious criminal offence to copy or attempt to copy any film or other copyright protected material shown in the Cinema.

Such crime is punishable on conviction with an unlimited fine and imprisonment of up to a maximum of 10 years.

6.3 Mobile phones and all other mobile devices must be switched off during the performance. However you are welcome to take photos and use mobile phones prior to the start of the performance when entering the Cinema.

6.4 Alcoholic beverages brought from outside of the premises may not be consumed on the premises, due to strict licensing laws.

6.5 No animals are permitted on the premises, except guide dogs and other assistance dogs for those with disabilities.

6.6 Smoking is not permitted within the premises in accordance with law, any individual caught smoking, including electronic cigarettes or any other artificial cigarettes or smoking devices within the building will be ejected immediately without any entitlement to a refund and a permanent ban in line with our zero tolerance policy. (Please note that we have designated outside smoking areas at the front and rear of the property).

6.7 Customers must keep personal belongings with them at all times. We cannot accept responsibility for the loss, theft or damage to any personal items brought into the premises. The Sussex Exchange offers over 80 car parking facilities situated at the front, side and rear of the building. Usage of car park facilities is strictly at the vehicle proprietor’s risk. The Sussex Exchange will not accept any liabilities for any damages, theft, loss or stolen property.

6.8 CCTV monitoring takes place within our premises for the purposes of protecting our staff, property and the safety of other Customers. Facial Recognition is in operation and in line with our zero tolerance policy.

6.9 In the event that a Customer(s) breaches our Admissions Policy, TSSL reserves the right to take all appropriate action to avoid a reoccurrence (including but not limited to banning such Customer(s) from the premises, we may also contact the police and take any necessary legal action if required.

6.10 TSSL Management team reserve the right to deny, refuse service or admittance and ejection of any guest(s) at any time and without any reason, explanation or prejudice.


7 Refunds & Cancellations

7.1 All bookings are non-refundable. Due to strict relationships with the film studios, unfortunately once the booking is confirmed TSSL cannot change, amend, move or transfer a booking under any circumstances.

7.2 In the event that TSSL cancel a showing it will take approx 3-4 working days to process in line with the Visa/MasterCard refund rules and our merchant provider’s policies.




8 Concession Stand

8.1 Our concession stand allows Customers to purchase snacks, soft drinks and alcoholic beverages both prior and after Cinema performances. All prices include VAT.

8.2 Purchases must be made in person via credit or debit card and cannot be requested in advance, this concession stand is operated on a first come, first serve basis.

8.3 Our concession stand will be available both prior and after the performance screening; however this may not be available during the performance, changes to this schedule are at the sole discretion of TSSL.

8.4 We reserve the right to ask for proof of age with appropriate photographic ID if you are purchasing alcoholic beverages. If you are unable to provide this upon request we will be unable to serve you alcoholic beverages. We reserve the right to ask for such proof at any time you are on our premises.


9 Liability 9.1 TSSL will endeavour to inform customers if there are any issues with any performances at the Cinema. However TSSL cannot be held liable for issues due to circumstances outside of our control. This can include but is not limited to:

• Technical Failures/Power Cuts • Changes made by the film studios • Customer Non-Attendance • Weather Conditions

9.2 In the event that any of the above affect any performance(s) TSSL will endeavour to provide alternative viewing times and/or refunds, however this is at the discretion of TSSL.

9.3 TSSL cannot take any responsibility if you are unable to attend your booked cinema screening for any of the following reasons:

• You have failed to attend the performance by the screening date and time specified. • You are not of a legal age to watch the performance. - Weather or road closure related non arrival. - Personal circumstances non arrival.


10 Data Protection & Privacy

10.1 All Customer information including but not limited to personal information, contact details and correspondence is kept confidential in our secure database. We will never reveal or sell your information to third parties.

10.2 We may use your contact information in the event that we need to contact you regarding your Cinema booking.

10.3 When placing a booking via our website you will automatically be added to our mailing list, from which we may occasionally send you information in relation to The Sussex Exchange Cinema. This information may include upcoming performances or seasonal events held at The Sussex Exchange, you are able to un-subscribe from our mailing list at any time.

10.4 The Internet offers a world of opportunity for children. Your guidance is essential to help ensure that children have a safe online experience. Children (persons under the age of 18) are advised to only use our Website under the supervision of a parent or guardian due to some age-restricted ratings for the performances advertised.
